1. Purpose and acceptance
These Terms of Sale (« Terms ») govern the sale of digital products and any other product or service offered on centrafriquepratique.com (the « Site »), published by SENIDUTI LLC, a Limited Liability Company incorporated under the laws of the State of Delaware (United States), with its registered office at 8 The Green, STE B, Dover, DE 19901, United States — hereinafter « the Seller » or « we ».
Any order placed on the Site implies the buyer's full and unreserved acceptance of these Terms (« the Customer » or « you »).
These Terms are permanently accessible on the Site in a format allowing their storage and reproduction by the Customer, in accordance with Article 36 of Decree No. 23.047 and Article 36 of Law No. 22.002.
Languages available for concluding the contract: French and English (art. 37 of Decree No. 23.047).
2. Products offered
The Site offers downloadable digital products for sale (practical guides, reference maps, printable postcards, administrative reference documents, and other digital content relating to the Central African Republic).
Other categories — print-on-demand products, craft items, subscriptions, or boxes — may be activated later depending on project phases, and will then require the necessary adaptations to these Terms.
The essential characteristics of each product, its availability, and its format are presented on its product page before purchase. Images and descriptions are indicative and may be subject to slight variation.
3. Prices
- Prices are shown in US dollars (USD), inclusive of all taxes, unless stated otherwise.
- The full price is displayed before the order is confirmed, including all taxes, charges, commissions, and related expenses (art. 8 and 9 of Decree No. 23.047; art. 6 of Law No. 22.002).
- An indicative equivalent in CFA francs (XAF) is displayed for Customers located in the Central African Republic, in accordance with Article 9 of Decree No. 23.047. Only the USD amount is binding for payment.
- As digital products incur no delivery costs, no shipping fee is charged. For any physical products, shipping costs are shown separately before payment.
- The Seller may change prices at any time; products are invoiced at the rate in force at the time the order is confirmed.
- Local taxes may apply depending on the Customer's location and are displayed before final payment.
4. Order process
Concluding the contract electronically follows these steps:
- selecting the product(s) and adding them to the basket;
- a detailed summary of the order and the total price;
- the ability to correct input errors and to amend or abandon the order before any confirmation;
- express confirmation of the order, constituting acceptance of these Terms;
- payment via the secure payment provider selected by the Seller, Lemon Squeezy;
- an acknowledgement of receipt sent without delay by electronic means.
These mechanisms are provided pursuant to Article 10 of Decree No. 23.047 and Article 37 of Law No. 22.002. The acknowledgement of receipt restates the Seller's identity and address, the essential characteristics and price of the product, payment and performance terms, the conditions of the right of withdrawal, the complaints service contact details, and termination conditions (art. 38 of Decree No. 23.047).
The Customer warrants that they hold the necessary authorizations to use the chosen payment method. The Seller may refuse or cancel any order in cases of suspected fraud, a prior payment dispute, or a manifest anomaly.
5. Delivery of digital products
- Digital products are made available by immediate download after payment is confirmed, or sent to the email address provided by the Customer.
- In any event, the Seller fulfils the order within a maximum of thirty (30) days from receipt, unless otherwise agreed between the parties (art. 12 of Decree No. 23.047).
- It is the Customer's responsibility to check the accuracy of their email address when ordering. The Seller cannot be held liable for non-receipt resulting from incorrect contact details, a spam filter, or a technical incident beyond its control, without prejudice to its obligation to resend the file on simple request.
- In the event of force majeure preventing performance within the required time, no additional charge is made to the Customer, who is refunded within thirty (30) days (art. 13 of Decree No. 23.047).
6. Right of withdrawal
The applicable regime depends on the Customer's place of residence.
6.1 Customers residing in the European Union
A consumer Customer has fourteen (14) days to exercise their right of withdrawal.
As this is digital content supplied without a physical medium, this right lapses as soon as the download begins, provided the Customer has beforehand:
- given their express consent to immediate performance of the contract, and
- expressly acknowledged that they thereby lose their right of withdrawal.
Both are collected via a separate checkbox at the time of payment. Failing that, the fourteen (14) day right of withdrawal remains fully intact and the refund is made free of charge.
6.2 Customers residing in the Central African Republic
The Customer has fourteen (14) days from receipt of the goods or service to cancel the transaction where the Seller has not provided the means to summarize the order, correct errors, and withdraw before ordering (art. 10 of Decree No. 23.047). The Seller implements these means as described in Article 4 above.
In the event of cancellation, the Customer ceases using the product and the Seller refunds payments received, less any direct return costs, within a maximum of thirty (30) days (art. 10 and 12 of Decree No. 23.047).
6.3 Other Customers
For Customers residing in the United States and other countries, no statutory right of withdrawal applies to digital content already delivered. The commercial warranty under Article 7 remains available.
7. Warranty and complaints
In the event of a proven technical defect — a corrupted, unreadable, or undelivered file, or one not matching the description of the offer — the Customer has fourteen (14) days from purchase to contact the Seller at contact@seniduti.com to obtain a replacement or a refund. This period is a goodwill service standard, applied without prejudice to the statutory guarantees the consumer Customer holds under the mandatory law of their country of residence — in the European Union, notably the conformity guarantee for digital content (Directive (EU) 2019/770), of at least two years from supply. Claims based on those guarantees may be raised through the same channel.
In accordance with Article 14 of Decree No. 23.047 and Article 7 of Law No. 22.002, the Seller is automatically liable for the proper performance of its contractual obligations, whether performed by itself or by other providers, unless it proves that non-performance is attributable to the Customer, to a third party unconnected with the contract, or to force majeure.
No refund is granted for a simple change of mind after delivery of the digital content, subject to Articles 6.1 and 6.2.
8. Intellectual property and permitted use
- Content sold on the Site — maps, illustrations, layouts, texts, and data compilations — remains the intellectual property of the Seller, unless stated otherwise.
- Purchase grants the Customer a personal, non-exclusive right of use: printing and use for private, family, educational, or research purposes.
- Without prior written authorization, the Customer may not resell, redistribute, republish online, or commercially exploit the purchased files.
- The underlying administrative and geographic data comes from public official sources (decrees, censuses) and is not appropriated by the Seller; however, its selection, compilation, formatting, and graphic presentation constitute a protected work.
- A commercial or institutional use licence may be granted on request at contact@seniduti.com.
9. Liability
- The Seller endeavours to ensure the accuracy of the administrative and geographic information presented, based on official sources available at the date of publication (notably Decree No. 24.149 of 30 May 2024 and RGPH-4 / ICASEES 2024).
- This content is provided for information only and constitutes neither an official document nor an enforceable administrative record. It cannot engage the Seller's liability in the event of subsequent administrative change, residual error, or misuse.
- The Seller is not liable for indirect damages arising from use of the Site or of purchased products.
- Nothing in these Terms limits the Seller's liability beyond what applicable law permits, notably in cases of wilful misconduct, gross negligence, or harm to personal safety.
10. Invoicing and archiving
- Invoicing is accepted in electronic form on the same footing as a paper invoice (art. 15 of Decree No. 23.047; art. 47 of Law No. 22.002).
- The Seller retains concluded electronic contracts for a minimum of ten (10) years from the end of contract performance and guarantees the Customer access at any time on simple request (art. 40 of Decree No. 23.047; art. 53 of Law No. 22.002).
11. Customer service
- Email: contact@seniduti.com
- Telephone: +1 302 508 4912
- Post: SENIDUTI LLC, 8 The Green, STE B, Dover, DE 19901, United States
- Indicative response time: within 2 to 3 business days
12. Personal data protection
Data collected when ordering is processed in accordance with the Privacy Policy (Section 6). Payment information is collected and processed directly by Lemon Squeezy (Lemon Squeezy, Inc., a Stripe company) and is not stored by the Seller.
Lemon Squeezy acts as the official reseller (Merchant of Record) for the digital products sold on the Site. This has legal consequences: it is Lemon Squeezy — not SENIDUTI LLC — that contracts directly with the Customer for the payment transaction, is responsible for collecting and remitting applicable taxes (VAT, local sales tax), and whose own terms of use apply to that transaction, in addition to these Terms.
13. Applicable law, complaints, and disputes
These Terms are governed by the law of the State of Delaware (United States of America).
However, in accordance with Article 3 of Central African Decree No. 23.047 and consumer protection rules applicable in the European Union, this choice cannot deprive a consumer Customer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
In the event of a dispute, an amicable solution will be sought as a priority. A consumer Customer residing in the European Union may use an out-of-court dispute resolution body competent in their Member State. Failing agreement, jurisdiction is attributed to the courts of Delaware, without prejudice to mandatory jurisdiction rules applicable to consumers.
14. Amendment of these Terms
The Seller may amend these Terms at any time. The applicable conditions are those in force on the date of the order.
